WHOLESALE TERMS & CONDITIONS

ORDER POLICY:

  • All prices are in US Dollars (USD)
  • Unauthorized discounts or rounding are not accepted
  • Shipping costs and customs duties are not included in the price.
  • All prices are FCA – Lima
  • MSRP price should be respected, or higher.
  • Terms: 40% Advance Payment / 60% before shipping.
  • All products ship from Peru.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

According to the calibration of different monitors used for the visualization of the page, the colours of the depicted products may vary slightly. We not be liable for errors arising from a misunderstanding.

While we do everything we can to ensure that all details, descriptions and prices which appear on this Web Site are accurate, errors may occur. If we discover an error in the price of any product that you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price, or cancelling your order. If we cannot contact you, we will treat the order as if it had been cancelled.


ORDERS:

When you place an order, you are sending a proposal for the purchase of a product in accordance with and subject to the following terms and conditions. All orders are subject to product availability and confirmation of the order price. Shipping times may vary according to availability and any warranty or affirmation offered with regard to delivery times. Pima Lima not be responsible for any delay caused by the transport agency or by force majeure. The products belong to Pima Lima until the total payment of the invoice.

Pima Lima will make one attempts to deliver your order to the address stated. In case to imposibility to leave the products, Pima Lima reserves the right to collect or withhold any sum due for return shipping, administrative costs and/or any compensation of damages.

The customer assumes all risk of damage / loss of the goods upon delivery to the transport agency. Immediately after delivery of the goods Pima Lima will be exempt from risk, where the risk is transferred to the client. Pima Lima not be responsible for any delay caused by the transport agency or by force majeure.


CALENDAR:

  • Order deadline: Feb 29th 2022
  • Delivery date: July 20th – Aug 20th 2022

PAYMENT POLICY:

  • You will receive your order confirmation by e-mail. If you don’t receive an e-mail, your order is not confirmed.
  • Once your order is confirmed, we will send you a pre-payment invoice of 40% of your total order. Prepayment
  • Remaining 60% will be paid in full before shipping.
  • Payment options are:
    • a) Credit Card (no PayPal)
    • b) PayPal (3% service charge will be added)
    • c) Direct bank wire transfer.
  • In the event of late payment, Pima Lima will be entitled to:
    • a) Charge a late payment interest on a monthly basis of 1.5%, at any given time, on the total amount overdue, form the first day overdue and until the balance is settled.
    • b) Suspend deliveries and/or cancel order, in that case Pima Lima may charged the amount paid in advance as compensation, without prejudice to the collection of the respective interests.

CANCELLATIONS:

  • No order can be cancelled 30 days prior to the first day of the “Delivery Date”. If this is not complied, Pima Lima can hold and keep the advance deposit of 430% of the order as compensation of damages without the obligation to deliver any products.
  • References may need to be cancelled due to minimum production reasons. Clients will be informed in due time.

RETURN POLICY:

  • Client is responsible for inspecting the merchandise upon receipt.
  • Clients are encouraged to take a photo of the package once it is received (proof of the security tape).
  • Shortage / Difference in packing list quantities must be declared within 72 hours of receipt.
  • Defects in manufacturing must be declared 30 days of receipt of order.
  • Returns as result of client’s error are subject to a 20% restocking fee, plus shipping.
  • Returned merchandise must be unused, in original packaging and is not worn, washed, damaged or had had the tags removed.
  • The Client must ship back the parcel with a tracked service in order to be able to monitor the returned items.

APPLICABLE LAW AND COMPETENT JURISDICTION

These terms and conditions shall be interpreted in accordance with, the laws of Peru and, in case of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the Peruvian courts in Lima.
